DMCA & Content Removal

This page explains how to ask Viralix ("Viralix", "Viralix.Video", "we", "us", or "our") to remove content that you believe infringes your copyright or otherwise violates our policies, and how we handle such requests. It also describes how users can respond if content they uploaded or delivered is removed in error.

This policy is intended to be consistent with the U.S. Digital Millennium Copyright Act ("DMCA") and similar laws in other jurisdictions. It should be read together with our Terms of Service and Content & IP Policy.

1. Scope

This policy covers:

  • requests to remove or restrict access to content on the Platform that allegedly infringes copyright; and
  • requests to remove or restrict content that violates our Content & IP Policy or Terms of Service (for example, harmful or abusive content).

We may remove or restrict access to content at our discretion where we reasonably believe it infringes rights, violates our policies, or presents a risk of harm, even if a request does not meet the formal requirements of a DMCA notice.

2. Reporting copyright infringement (DMCA-style notice)

If you believe that content on the Platform infringes your copyright (or the copyright of someone you are authorized to represent), you may submit a written notice that includes the following information:

  • Your full name, mailing address, and email address (and, if applicable, the name of the organization you represent).
  • A description of the copyrighted work you claim has been infringed, or a representative list if multiple works are covered.
  • A description of the content on Viralix that you claim is infringing, including a URL or other information reasonably sufficient for us to locate it (for example, a project reference).
  • A statement that you have a good‑faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
  • Your physical or electronic signature (for example, typing your full name at the end of the notice).

Please send your notice to support@viralix.video with the subject line "Copyright / DMCA Notice".

We may share the contents of your notice (including your contact details) with the user who posted the content and with relevant third parties as needed to process your request.

3. Content removal and account actions

Upon receiving a complete and facially valid notice, we may take one or more of the following actions:

  • remove or disable access to the allegedly infringing content;
  • notify the user who posted or delivered the content with a copy or summary of the notice; and
  • request additional information from either party if clarification is needed.

In appropriate circumstances, we may also limit, suspend, or terminate the accounts of users who are found to be repeat infringers or who commit serious violations of our policies, in line with our Terms of Service.

4. Counter-notices (if your content was removed)

If your content was removed or disabled because of a copyright complaint and you believe this was a mistake or that you have the right to use the material (for example, because you have permission, a license, or your use is otherwise lawful), you may submit a counter‑notice.

Your counter‑notice should include:

  • Your full name, mailing address, and email address.
  • Identification of the content that was removed or to which access has been disabled, and the location at which the content appeared before it was removed or access to it was disabled.
  • A statement, made under penalty of perjury, that you have a good‑faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the courts in your country of residence (and, if applicable, where Viralix is located) and that you will accept service of process from the person who submitted the original notice or their agent.
  • Your physical or electronic signature (for example, typing your full name at the end of the notice).

Please send your counter‑notice to support@viralix.video with the subject line "Counter‑Notice". We may share your counter‑notice with the original complainant and with relevant third parties as needed to process the request.

Where required by law, we may restore access to the content if the original complainant does not inform us that they have filed legal action within a specified time period after receiving your counter‑notice.

5. Reporting other policy violations or harmful content

You can also ask us to review content that is not about copyright but that you believe violates our Content & IP Policy or Terms of Service (for example, harmful, abusive, misleading, or privacy‑invasive content).

To report such content, please contact us at support@viralix.video with:

  • a link or reference to the content or project;
  • a brief explanation of why you believe it violates our policies or applicable law; and
  • any supporting documentation you can reasonably provide.

We will review reasonable reports and may remove or restrict access to content, contact the relevant users, or take other actions we consider appropriate under our policies.

6. Repeat infringers

In accordance with the DMCA and our own policies, we may terminate or limit access to the Platform for users who are found to be repeat infringers of third‑party rights or who repeatedly submit abusive or clearly unfounded notices.

We will consider factors such as the number and validity of notices, the severity of violations, and whether the user has previously been warned or had content removed for similar reasons.

7. No legal advice; region-specific rules

Nothing in this page constitutes legal advice. If you are unsure whether content infringes your rights or whether your use of content is lawful, you should seek legal advice in your jurisdiction.

Different countries have different rules about notice‑and‑takedown procedures and fair use or similar concepts. We will handle notices in good faith and in line with applicable law, but we cannot advise you on your legal position.

8. Changes to this DMCA & Content Removal policy

We may update this DMCA & Content Removal policy from time to time. When we make material changes, we will take reasonable steps to notify you (for example, by updating the "Last updated" date or showing a notice on the Platform).

Your continued use of the Platform after the updated policy becomes effective means you agree to the changes.
